County Road F <br />Vadnais Heights, Minnesota 55110 <br />Gentlemen: <br />At the request of Joe Chlebeck, we have drafted a proposed form of <br />Resolution authorizing withholding and escrowing of the charges <br />attributable to the treatment of lake overflow. <br />I call your attention to the following, Minnesota Statutes, Section <br />473.527, Subdivision 4 thereof, which provides in pertinent part as <br />follows: <br />"Deficiency Tax Levies. If the governing body of any <br />local government unit fails to meet any payment tb the <br />Commission hereunder when due, the Metropolitan Council <br />may certify to the auditor of the county in which the <br />government.. unit is located the amount required for pay - <br />ment of such amount with interest at six (6 %) percent <br />per annum. The auditor shall levy and extend such <br />amount as a tax upon all taxable property in the govern- <br />ment unit for the next calendar year, free from any <br />existing limitations imposed by law or charter. Such <br />tax shall be collected in the same manner as the general <br />taxes of the government unit, and the proceeds thereof, <br />
