PAUL, MINNESOTA 55102 <br />Since the last Council meeting, I have had the opportunity <br />to review the existing Little Canada ordinances relative to the <br />above- captioned matter. Minn. Stat. Section 412.221, Subd. 23, <br />enables the Council to define nuisances by ordinance and to provide <br />for the abatement of same. In this regard, please find enclosed a <br />copy of pages 67 through 72 of the Little Canada Municipal Code. <br />You will notice that accumulations of rubbish and debris are <br />declared to be nuisances on page 68; that the storage of wrecked <br />or junked vehicles and the depositing of materials in streets <br />are declared to be nuisances on page 70. <br />Section 601.080, on page 71, provides that the nuisance may <br />be abated by the City and the cost of such abatement may be spread <br />against the property upon which the nuisance existed. <br />In addition to this authority by ordinance, Minn. Stat. Section <br />429.101 provides that "the governing body of any municipality may <br />provide for the collection of unpaid special charges for all or any <br />part of the cost of ... removal or elimination of public health <br />or safety hazards from private property ..., as a special assessment <br />against the property benefited. ..." Such special assessment "shall <br />be payable in a single installment, or by up to ten equal annual <br />installments as the council may provide." <br />Would you please submit this letter to the Council for their <br />consideration.
