601.090. PENALTIES. Any person who shall cause or create a nuisance, <br />or permit any nuisance to be created or placed upon, or to remain upon any <br />premises owned or occupied by him, and any person who shall fail to comply <br />with any order made under the provisions of this Code, upon conviction thereof <br />shall be guilty of a misdemeanor and shall be punished by a fine of not more <br />than Five Hundred Dollars ($500.00) or by imprisonment in the county jail for <br />not more than ninety (90) days. <br />601.100. SEPARABILITY. Every section, provision or part of this <br />Chapter is declared separable from every other section, provision or part; and <br />if any section, provision or part hereof shall be held invalid, it shall not <br />affect any other section, provision or part. <br />• (Source: Ord. 29) <br />602. PROHIBITION OF CERTAIN OPEN FIRES ON BALCONIES. <br />602.010. DECLARATION OF POLICY. The City Council for Little Canada <br />' has determined that the increasing popularity of open fire barbecues on <br />apartment building balconies has created new fire hazards which endanger the <br />health and safety of the residents of Little Canada and for which no safety <br />precautions are provided in the existing municipal Code. It is hereby <br />declared to be the intention of the Council to promulgate rules and controls <br />which will effectively prevent tragedies from occuring in multiple dwellings <br />as a result of such activities within Little Canada's boundaries. <br />602.020. PROHIBITED BURNING. It shall be unlawful for any person or <br />persons to start, light, keep, burn, maintain or otherwise have an open fire <br />on any balcony of any apartment building for the purpose of barbecuing, <br />cooking or any other recreation purpose unless the burning receptacle is of <br />such a type and design as to absolutely preclude the spilling out of any part <br />of the burning materials, whether wood, charcoal, briquets or other type of <br />fuel, onto the balcony floor or off of the balcony itself. Such receptacle or <br />device shall be attached or affixed to the floor or wall or railing in such a <br />way as to render it incapable of being tipped over or tilted so as to allow <br />the burning contents to be spilled therefrom. In addition, all such <br />receptacles or devices shall be covered sufficiently to prevent the spilling, <br />blowing or drifting of sparks, embers or ashes and shall be equipped with legs <br />at least 10 inches at length to insure against the heat from the bottom or <br />sides of such receptacles or devices from burning or damaging any surface upon <br />which they may be placed. <br />602.030. LIGHTER FLUIDS PROHIBITED. No charcoal lighter fluids or <br />other flamable liquids or semi — liquids shall be used as igniters for fires of <br />any type on apartment balconies. Only electric type fire starters shall be <br />allowed. <br />
