ORDINANCE NO. AN ORDINANCE AMENDING THE LITTLE CANADA CODE BY ADDING CHAPTER 2901 PROVIDING FOR DEFERMENT OF SPECIAL ASSESSMENTS ON HOMESTEAD PROPERTY OWNED BY SENIOR CITIZENS OR DISABLED PERSONS. THE COUNCIL OF THE CITY OF LITTLE CANADA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That the Municipal Code of Little Canada, Chapter 2901, is hereby amended to read as follows: "2901. DEFERRED ASSESSMENTS 2901.010. Deferred Special Assessments for Senior Citizens and Disabled Persons. The City Council, pursuant to Minnesota Statutes 1974, Section 435.193 and amendments thereto, may, at its discretion, defer the payment of special assessments for any homestead property owned by a person 65 years of age or older or retired by virtue of a permanent and total disability for whom it would be a hardship to make the payments. 2901.020. Hardship Defined. A hardship may be deemed to exist if the average annual payments of all assessments levied against the subject property shall exceed 1% of the applicant's adjusted gross income as determined by his Federal Tax Return filed in the year previous to the certification of the levy. The average annual payment of an assessment shall be the total cost of the assessment divided by the number of years spread. The Council may also determine hardship on the basis of exceptional and unusual circumstances not covered herein. 2901.030. Existing Deferments..Any person who is over 65 years of age or disabled and who has been granted a deferment by reason of age or disability prior to the enactment of this ordinance shall be required to make application for a continuation of said deferment pursuant to the provisions of this .ordinance. Such applicants shall be required to show evidence of hardship as herein defined in order to continue receiving a deferment and a failure to qualify for a deferment shall result in the termination of said deferment effective at a time chosen by the City Council at its discretion. 2901.040. Renewal. The application shall be renewed every 5 years and said application, obtainable from the City Clerk, shall be submitted to the City Clerk at least 30 days prior to the expiration of said 5 year period. 9
