ORDINANCE NO. <br />AN ORDINANCE AMENDING THE LITTLE CANADA CODE BY <br />ADDING CHAPTER 2901 PROVIDING FOR DEFERMENT OF <br />SPECIAL ASSESSMENTS ON HOMESTEAD PROPERTY OWNED <br />BY SENIOR CITIZENS OR DISABLED PERSONS. <br />THE COUNCIL OF THE CITY OF LITTLE CANADA DOES HEREBY ORDAIN AS FOLLOWS: <br />Section 1. That the Municipal Code of Little Canada, Chapter 2901, is <br />hereby amended to read as follows: <br />"2901. DEFERRED ASSESSMENTS <br />2901.010. Deferred Special Assessments for Senior Citizens and Disabled <br />Persons. The City Council, pursuant to Minnesota Statutes 1974, Section 435.193 <br />and amendments thereto, may, at its discretion, defer the payment of special <br />assessments for any homestead property owned by a person 65 years of age or <br />older or retired by virtue of a permanent and total disability for whom it would <br />be a hardship to make the payments. <br />2901.020. Hardship Defined. A hardship may be deemed to exist if the <br />average annual payments of all assessments levied against the subject property <br />shall exceed 1% of the applicant's adjusted gross income as determined by his <br />Federal Tax Return filed in the year previous to the certification of the levy. <br />The average annual payment of an assessment shall be the total cost of the <br />assessment divided by the number of years spread. The Council may also <br />determine hardship on the basis of exceptional and unusual circumstances not <br />covered herein. <br />2901.030. Existing Deferments..Any person who is over 65 years of age <br />or disabled and who has been granted a deferment by reason of age or disability <br />prior to the enactment of this ordinance shall be required to make application <br />for a continuation of said deferment pursuant to the provisions of this <br />.ordinance. Such applicants shall be required to show evidence of hardship as <br />herein defined in order to continue receiving a deferment and a failure to <br />qualify for a deferment shall result in the termination of said deferment <br />effective at a time chosen by the City Council at its discretion. <br />2901.040. Renewal. The application shall be renewed every 5 years and <br />said application, obtainable from the City Clerk, shall be submitted to the City <br />Clerk at least 30 days prior to the expiration of said 5 year period. <br />9 <br />
