PAUL, MINNESOTA 55117 GENERAL MANAGER <br />December 21, 198i <br />Little Canada City Council <br />Little Canada Planning Commission <br />Mr. Joe Chlebeck, Mayor <br />Re: Lot Split Application- Variance <br />Labore Road <br />Gentlemen: <br />Application for a lot split and variance under Section <br />922.010 (.C)(2) of the Little Canada Zoning Code, hereinafter <br />Code, is hereby made. The subject site is located along Labore <br />Road and abuts property addressed as 2959 Labore Road, Little <br />Canada. The subject site is currently coned R -1 (Single Family <br />Residential District). The proposed lot split would meet all of <br />the requirements of Section 905.050 (Lot requirements and setbacks) <br />except that each of the lots would be approximately 2.5 feet <br />short of the required 75 foot lot width requirement for an internal <br />lot. (It is understood that this width is to be measured from <br />the property setback line). <br />The lots would each have an 80 foot frontage along Labore <br />Road. However, because of the irregular shape of the subject <br />site the width at the 30 foot setback line would be slightly under <br />the required footage. <br />Appiioant believes that a lot width variance should be <br />granted because: <br />(1). Such a variance would not adversely impact upon the <br />surrounding neighborhood, as required by Section 922.010(C)(1). <br />(2). The applicability of Section 922.010(C)(2)a through b <br />which would allow for the granting of a variance when special <br />conditions peculiar to the land, such as its shape, make strict <br />adhearance to the Code overly burdensome. <br />(3). The lot width requirement is designed to space buildings <br />for health, safety and ascethic reasons. If no further variances, <br />such as sidelot requirements, are requested, these purposes are <br />still accomplished. Any controls required could be exercised <br />through limitations on building permits to be issued. <br />The actual lot split would be made in accordance with the <br />
