Little Canada Planning Commission, <br />Mayor and City Council <br />1 February 1982 <br />Page Two <br />In discussing this with the City Attorney, we were informed that conditions <br />imposed under such a P.U.D. agreement would likely be difficult or impossible <br />to enforce at some future date. In addition, allowing a nonconforming sub- <br />division via a P.U.D. may set an undesirable precedent in terms of the use of <br />planned unit development. <br />RECOMMENDATION <br />In view of the problems noted above, we cannot recommend approval of the <br />request. There are too many parcels in the community which would have to <br />be treated similarly to justify the variance. Nor can we jeopardize the use <br />of planned unit development within the City by using it to maintain non- <br />conforming property.
