I- tanson <br />As discussed at the last Council meeting, one of the licensing requirements for Tobacco Stores is <br />that license renewal application materials include "sufficient financial information" to show that <br />the store is in compliance with the requirement that 90% of gross revenue is derived from the <br />sale of approved products. Approved products include cigars, cigarettes, loose tobacco, cigarette <br />or cigar lighters, and tobacco - related devices. Another requirement is that no more than 50% of <br />the gross revenue of the store may be derived from the sale of tobacco- related products (any <br />pipe, rolling papers, ashtray, or other device which enables the chewing, sniffing or smoking of <br />tobacco or tobacco products). City staff informed the Council that it has been an onerous task to <br />delve into a mass of business receipts and tax returns. Therefore, staff recommended the <br />Tobacco Ordinance be amended modifying the requirement for submission of financial <br />information. <br />Staff had proposed that a statement be included on the Tobacco Store License Application <br />certifying compliance with these Code requirements, and only if the City deemed necessary <br />would the applicant would be required to submit financial information. In considering this <br />recommendation, the Council directed that the business owner be required to provide summary <br />financial information, and, if deemed necessary, the additional financial information would be <br />required. <br />Attached is a proposed amendment to the Tobacco Ordinance that staff believes complies with <br />that direction. Also attached is a Tobacco Store License Application that provides for the <br />reporting of the summary information. <br />If this meets the Council direction provided, staff is requesting that the attached ordinance <br />amendment be adopted. <br />1 <br />
