MINUTES <br />CITY COUNCIL <br />MAY 22, 2013 <br />TOBACCO <br />ORDINANCE <br />AMENDMENT <br />*ADOPTION OF AN ORDINANCE AMENDMENT FEE SCHEDULE <br />RELATIVE TO LAWN SPRINKLER WATER RATE, SEWER AND <br />WATER RATES, TRASH AND RECYCLING RATES, AND ON -SALE <br />LIQUOR AND ON -SALE WINE LICENSE FEES AS <br />RECOMMENDED BY CITY STAFF; <br />*APPROVAL OF FIREWORKS CONTRACT FOR THE 2013 <br />CANADIAN DAYS CELEBRATION <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />The City Administrator reviewed his report dated May 17, 2013 <br />recommending an amendment to the Tobacco Ordinance. He noted that <br />when the ordinance was amended a couple of years ago Tobacco Stores <br />were required to submit sufficient financial information to show that the <br />store is in compliance with the requirement that 90% or more of gross <br />revenue is derived from the sale of approved products and that no more <br />than 50% of gross revenue is derived from the sale of tobacco - related <br />products. The Administrator indicated that from staff' s perspective, this <br />requirement has been onerous to enforce reporting that the Tobacco Store <br />owners have delivered boxes of receipts for staff review. The <br />Administrator recommended that the ordinance amendment allow for the <br />owners of Tobacco Stores to sign an affidavit stating their compliance <br />with the ordinance. The submission of financial information would still be <br />required if staff deemed it necessary. <br />Montour suggested that the affidavit include summary financial <br />information to be reported by the Tobacco Store owner, i.e. total gross <br />revenues, total gross revenue derived from the sale of approved products, <br />total gross revenue derived from the sale of tobacco - related products. <br />Montour suggested that if there is a question relative to the figures <br />reported, the City could then require financial information to be submitted <br />to compare with the figures submitted. Council agreed with this <br />suggestion. <br />The City Administrator reported that he would incorporate this <br />recommendation and bring the matter back to the next Council meeting. <br />11 <br />2 <br />
