MINUTES <br />CITY COUNCIL <br />OCTOBER 24, 2006 <br />Montow• noted that if the four-plex property owners were presented with a <br />$14,000 assessment estimate, these owners may have objected Co Che <br />improvement. However, while there may have been 9 commercial <br />property owners objecting to the improvement, there would likely have <br />been ] 6 residential property owners in favor of Che improvement. <br />Therefore, the improvement of Ruth Sheet would have been ordered. <br />Montour also noted that the error was discovered in February and property <br />owners were informed of the revised assessment estimate. Montour stated <br />that he was unaware of any property owners Yhat raised concern at that <br />time. <br />Wheaton stated that he would like to review the City's Assessment Policy. <br />The City Administrator suggested that action on the assessment could be <br />tabled to Comorrow evening to allow Wheaton time to review the policy <br />and prepare a written objection. The City Administrator noted that staff <br />will still be recommending adoption of Che assessment roll as presented, <br />however. Wheaton did not feel that was adequate time to rally the owner <br />owners of the four-plexes. Wheaton indicated ChaC you cannot fight City <br />Hall, and stated thaC he did not want to attend another meeting. Wheaton <br />also indicated that he would not be presenting a written objection to the <br />assessment. <br />The City Administrator noted Chat presentation of a wriCCen objection <br />tonight preserves the property owners' rights to contesC the assessment in <br />District Court. Wheaton stated that he ca~mot contest an assessmentjust <br />because he does not like it. <br />There was no one else present wishing to comment on this matter. <br />Upon motion by Allan, seconded by Keis, the public hearing was closed. <br />Mr. Blesener introduced the fo]lowing resolution and moved its adoption: <br />RESOLUTION NO. 2006-70-246 -ADOPTING THE ASSESSMENT <br />TOR IMPROVEMENT NO. 2006-03, I2 UTH STREET, AS <br />PRESENTED <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />IMP. NO. Mayor Blesener opened the Public Hearing to consider adoption of the <br />2006-02 - assessment for Improvement No. 2006-02, Sextant Avenue from <br />SEXTANT Savage Lane to Morrison Street by street reconstruction, concrete curb <br />
