These are the jurisdiction of the <br />City Engineer and it is assumed that his office will comment on their adequacy. <br />This aspect of the project responds to the most significant shoreland concern <br />which would be regulated by a shoreland impact plan. In this regard, yet to <br />be determined is whether the draft EAW should be finalized and processed or <br />whether the project should be processed under the proposed shoreland regulations. <br />Our office's preliminary analyses suggest that provided all the details such <br />as water quality are addressed and adequately attended to, the project would <br />meet the proposed shoreland requirements. <br />The many related and interrelated aspects of the townhouse, quad and multiple <br />family units require some form of control, coordination and regulation. A <br />property owners' association seems to be necessary to define these aspects of <br />development. Depending upon the desires of the applicant as well as the <br />feelings of the City Attorney, it may be advisable to have three such agreements, <br />one for the townhouses, one for the quads, and one for the apartments. <br />CONCLUSION <br />In summary, the following issues have been identified by this report: <br />1. County Road C right -of -way width- - <br />2. Ownership and maintenance of outlot A-- <br />3. Area and unit count of townhouses, quads and apartments <br />4. Separation of townhouse buildings <br />5. Drainage and utility easements on outlot B <br />6. Width and location of duplex driveway <br />7. Easement and maintenance agreement for emergency vehicle access <br />8. Building siting for apartment structure proposed on Lot 11 <br />9. Internal open space and recreational area <br />10. Arrangement and location of parking for apartments, townhouses, <br />and quads <br />11. Construction specifications for driveways <br />12. Improved and increased landscaping and screening <br />13. Consideration of building height of apartment structures <br />14. Consideration of drainage, grading, erosion control, and water <br />quality maintenance plans by the City Engineer <br />15. Submission of property owners' association agreements for review <br />and approval by City Attorney <br />16. Resolution of whether to process the EAW or proceed under new <br />shoreland zoning regulations. <br />
