Chlebeck
City Clerk
515 Little Canada Road
Little Canada, Minnesota 55117
Re: Senior Citizen's Facility
Our File No. 4677
Dear Joe:
SUITE 350
NORTHERN FEDERAL BUILDING
SIXTH AND WABASHA
ST. PAUL, MINNESOTA55102
There are two questions relative to the above - captioned
project that should be addressed by the City Council. Section
2101.020 of the Little Canada Code would require land dedication
for public use relative to the sale of property to the City for
the Senior Citizen's Facility. Approval of the subdivision by
the City Council may also be necessary prior to the recording of
the conveyance documents. Since the City is purchasing the
property and donating it to the development corporation, I am
assuming that the City intends to waive the required land
dedication. The subdivision should be approved by the City
Council by waiving the platting restrictions so that there will
be no question about recording of the conveyance documents.
Section 2101.050 of the Little Canada Code sets forth a park
charge for multiple dwellings that exist in subdivisions that
have not already paid a park charge. Once again, I am assuming
since the City is financing this project to the extent of the
contribution of the land, the City Council will waive the
required park charge.
If you have any questions relative to this matter, please
contact me.
TMS:slc
Yours very truly,
SWEENEY, O'CONNOR & LeMAY
i
Thomas M.
