Our firm represents the City of <br />Little Canada and we serve as planning consultant to the community. <br />Within the last several years, Mr. Chris Drake has attempted to process <br />a subdivision dealing with his property and which also impacts adjoining <br />parcels. Throughout the City's review of this, it was assumed that the <br />individual that Mr. Drake was dealing with was the outright owner of the <br />additional properties included. Apparently to Mr. Drake's surprise, as <br />well as that of the City, this ownership was not in fact a reality, rather <br />the University of Minnesota Foundation is the apparent title holder of <br />the parcels in question. <br />Mr. Drake, as well as the City, assumed that we had concluded resolution <br />of the layout and future development of this property. We have, however, <br />subsequently learned that the University of Minnesota Foundation does not <br />apparently concur with the development and layout which has been proposed. <br />While at this point, we are a second party to the overall matter, in that <br />Mr. Drake is dealing with the Foundation's attorney, we have been informed <br />that a number of comments have been made that the land apparently has some <br />use as a possible park site for the City or County, or that the property <br />is generally saleable. Not being involved in such conversations, nor having <br />seen any reports prepared by your agents, I cannot comment as to the validity <br />of the statements which are being made. I do, however, want to stress to <br />you that any time property involves a variance requirement, it is looked <br />at extremely seriously in the City of Little Canada and certainly nothing <br />should be considered automatic in terms of possible development. <br />4820 minnetonka boulevard, suite 420 minneapolis, mn 55416 612/925-9420 <br />
