14. Cleanup. The Developer shall promptly clear any soil, earth <br />or debris resulting from construction work by the Developer of its agents <br />or assigns. <br />15. Park Dedication. The Developer shall pay a cash contribution <br />_.. .._._...... <br />of Three Hundred ($300) Dollars per single family attached and detached unit <br />and One Hundred ($100) Dollars per multiple family unit in satisfaction of the <br />City's park dedication requirements. The contribution shall be paid at the time <br />a building permit is issued for the unit. <br />16. Dwelling Units. the type and general style of dwelling units <br />(single family, two family, townhouse, quadraminium, and multiple family) <br />shall be confined to the areas indicated on Exhibit A. Within these general <br />unit classifications, design variations may occur. In no case, however, shall <br />the number of units exceed that depicted on Exhibit A. As allowed under the <br />PUD provisions of the City Code, the height of the multiple family structures <br />shall not exceed forty -four (44) feet. <br />17. Parking. Those parking spaces indicated in Exhibit A as <br />"optimal - future" shall not be required during initial construction or occupancy <br />of the PUD. At any time after six (6) months of project completion and occupancy, <br />should the City determine that there exists a parking shortage in the area of <br />the multiple family units and /or the townhouse units, the City Council may direct <br />the Developer or Property Owners Association to construct the stalls as indicated <br />on Exhibit A. The time for such construction shall be at the option of the <br />City Council taking into account weather conditions. <br />18. Effect of PUD Approval. For ten years from the date of <br />this Agreement, no amendments to the City's Comprehensive Plan or official <br />controls shall apply to or affect the use, development density, PUD size, <br />PUD layout or dedications required or permitted by the approved development <br />stage plans, unless required by state or federal law or agreed to in writing <br />by the City and the Developer. Thereafter, notwithstanding anything in <br />this Agreement to the contrary, to the full extent permitted by state law, <br />the City may require compliance with any amendments to the City's Compre- <br />hensive Plan, official controls, PUD or dedication requirements enacted <br />after the date of this Agreement, and may require submission of a new PUD. <br />87 <br />
