NORTHWEST ASSOCIATED CONSULTANTS INC. <br />MEMORANDUM <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: 6 October 1983 <br />RE: Wright - Variance <br />FILE NO: 758.09 - 83.45 <br />RIVEP71 <br />OCi iz' 3 •93 <br />CITY OF <br />LITTLE CANADA <br />BACKGROUND <br />American Home and Construction has applied for a variance from the side <br />yard setback for a house and garage to be located on a lot owned by David <br />Wright. The proposed development is to be located on the southwest corner <br />of Ruth Street and the platted, but not constructed, Lake Street (see <br />Exhibit A, Area Location Map). <br />The City Council has expressed a desire to see the Lake Street right -of -way <br />maintained as open space, as opposed to paving or vacating it. <br />ANALYSIS <br />The proposed construction meets or exceeds all Little Canada requirements and <br />performance standards for an R -1 district, with the exception of the side <br />yard setback for which the variance is requested. The Little Canada Zoning <br />Ordinance requires a 10 foot side yard setback with the added provision for <br />30 feet on a corner lot. The proposed plan shows a 5 foot distance between <br />the side lot line and the garage (see Exhibit B, Plot Plan). <br />RECOMMENDATION <br />Since the City Council has demonstrated a desire to keep the Lake Street <br />right -of -way unimproved and to retain it as open space, the side yard setback <br />can be reasonably waived.
