ORDINANCE NO. 214 <br />AN ORDINANCE AMENDING THE <br />LITTLE CANADA ZONING ORDINANCE <br />TO PROVIDE FOR SFIOREL,AND REGULATIONS <br />THE CITY COUNCIL OF THE CITY OF LITTLE CANADA DOES HEREBY ORDAIN AS FOLLOWS: <br />Section 1. The Municipal Code of Little Canada, Section 902.010 is hereby <br />amended to read as follows: <br />12.1 Boathouse. A structure used solely for the storage of boats or boating <br />equipment. <br />21.1 Clear- cutting. The removal of an entire stand of trees. <br />63.1 HardshiQ_ A situation where property in question cannot be put to a <br />reasonable use under the conditions allowed by the official controls; <br />the plight of the landowner is due to circumstances unique to his <br />property, not created by the landowner; and the variance, if granted, <br />will not alter the essential character of the locality. Economic con- <br />siderations alone shall not constitute a hardship if a reasonable use <br />for the property exists under terms of the official controls. <br />112 Public Waters (Protected Waters). Any waters of the State as defined <br />in Minnesota Statutes 1979, Section 105.37, Subdivision 14, not in- <br />cluding, however, a lake, pond or flowage of less than tern (10) acres <br />in size or a river or stream having a total drainage area less than <br />two (2) square miles. In addition, bodies of water created by private <br />users, where there was no previous shoreland (for a designated private <br />use authorized by the Commissioner of Natural Resources) shall also not <br />be considered public waters and thus exempt from the provisions of <br />Section 917 of this Ordinance. The official determination of the size <br />and physical limits of drainage areas of rivers and streams shall be <br />made by the Commissioner of Natural Resources. The official size of <br />lakes, ponds, or flowages shall be the areas listed in the Division of <br />Waters, Soils and Minerals Bulletin 25, an Inventory of Minnesota Lakes, <br />or in the event that lakes, ponds or flowages are not listed therein, <br />official determination of size and physical limits shall be made by the <br />Commissioner in cooperation with the City of Little Canada. <br />126.1 Shoreland_Use-Substandard. Any use of shorelands existing prior <br />to 1 October 1983 which is permitted within the applicable zoning <br />district, but noes not meet the minimum lot area, length of water <br />frontage, structure setbacks, or other dimensional standards of the <br />Shoreland District. <br />Section 2. The Municipal Code of Little Canada, Section 917 is hereby amended to <br />read as follows: <br />20 <br />
