PLANNED UNIT DEVELOPMENT AGREEMENT <br />This Agreement, made and entered into on this day of <br />, 1983, between the City of Little Canada, a <br />municipal corporation of the State of Minnesota, hereinafter <br />called the "City ", and Thomas L. Krejci, and Barbara A. Krejci, <br />husband and wife, contract purchasers of the property described herein, <br />pursuant to a Contract for Deed, dated November 1, 1980, between <br />Independent School District No. 623, Roseville, Minnesota, and <br />Thomas L. Krejci and Barbara A. Krejci, and Joseph M. Brinkman, and <br />Jane A. Brinkman, husband and wife, contract purchasers of part of the <br />property described herein, pursuant to a Contract For Deed, dated <br />August 31, 1982, between Thomas L. Krejci and Barbara A. Krejci, <br />and Joseph M. Brinkman and Jane A. Brinkman, hereinafter called <br />"Owner ". <br />Owner owns the following described property situated in the <br />City of Little Canada, County of Ramsey, State of Minnesota: <br />The Southwest Quarter of the Southwest Quarter <br />of Section 5, Township 29 North, Range 22 West <br />bounded on the South by the South line of said <br />Section 5; on the East by the East line of the <br />Southwest Quarter of the Southwest Quarter of <br />Section 5; on the North by Gervais Creek, so- <br />called; and on the West by the Easterly line of <br />the St. Paul Water Works Right of Way. <br />The above described property is zoned R -B, Residential - Business <br />District, subject to a Conditional Use Permit. <br />ALLOWABLE USES. <br />The allowable uses are the existing day care center, dental <br />laboratory, rental office space, and rental hall, as shown on the <br />Site Plan, the Lower Floor Plan, the Upper Floor Plan, and a sketch <br />of the layout of the lower floor of the 1934 two story facility, <br />all of which are filed with the City. Such uses shall comply with <br />Section 908 of the Little Canada Zoning Code. <br />LAND USES. <br />1. Only those uses listed herein are permitted on the property <br />described above. <br />2. Land uses permitted shall be located, constructed, occupied <br />and maintained in accordance with the provisions of this Agreement <br />and in accordance with approved plans and other documents attached <br />hereto and made a part of this Agreement. <br />3. An Occupancy Permit shall be required for uses in all <br />buildings, pursuant to the applicable provisions of State law and <br />City ordinances. <br />4. No bingo occasions shall be allowed on the property. <br />
