THCIMAS M.SW
SWEENEY, O'CONNOR & LeMAY
PROFESSIONAL ASSOCIATION
ATTS'N .T
JAMES J. O'CONNOR
JOHN H. LeMAY
GEORGE F. BORER
Mr. Don Carley
Milner W. Carley & Associates
500 West Highway 96
Saint Paul, Minnesota 55112
(612) 2222541
June 28, 1983
Re: City of Little Canada— Mostad Property
Our File No. 4588
Dear Don:
NORTHERN FEDERAL BUILDING
SIXTH AND WABASHA
ST. PAUL, MINNESOTA 55102
As you perhaps know, the City of Little Canada is purchasing from Mrs.
Mostad, property described in the attached Exhibit A to this letter. This
property is a portion of a larger parcel described as "All of Tract A except
the north 100 feet of the west 300 feet, Registered Land Survey No. 109, files
of the Registrar of Titles, County of Ramsey ".
In submitting the description of the property the City is purchasing to
the Ramsey County Recorder's Office we were informed by Mr. William Reipe, of
that office that they would not accept that description for recording without
a registered land survey. I was not clear as to his precise reasons for
refusing to record it, but nevertheless his position appears to be firm i-
that regard.
We have reached an agreement with the seller of the property, through her
attorney, John Daubney, that they would split with the City, the costs of
obtaining a registered land survey of the new parcel. Mr. Daubney also agreed
that we would ask your firm to prepare the registered land survey on our
b
,half.
I would therefore ask that you contact Mr. Reipe at the Ramsey County
Recorder's Office and, inquire as to his specific concerns about the
description as proposed and then proceed to have the registered land survey
prepared and submitted to them for approval, as soon as possible. I do
believe it would be helpful to contact him prior to your commencing work on
this project.
We would sincerely appreciate your proceeding with this at your earliest
convenience, in order that the transaction may be consummated as quickly as
possible.
s3
