Little Canada Planning Commission, <br />Mayor and City Council <br />3 January 1983 <br />Page Two <br />ANALYSIS /RECOMMENDATION <br />Mr. Frattalone has asked if splitting off the portion of land with the build- <br />ing on it and combining it with his agricultural property would preclude him <br />from having to obtain a building permit. While this is a determination that <br />the Building Official and City Council will have to make, in our opinion, <br />dividing the property is quite a bit to go through to avoid a building permit. <br />As previously stated, the structure still requires a conditional use permit. <br />In this regard, we see no problem with granting the permit. It is suggested <br />that the approval be conditioned, however, on the structure being used only <br />by the applicant for his fanning operation. In no event should it be rented <br />out to some otheY individual other than perhaps the tenant of the rental unit. <br />Also, if the building is to be used at some later date for a home occupation <br />other than farming, the owner shall apply for appropriate City approval. <br />As a final note, it should be pointed out that recent State legislation requires <br />that conditional use permits as well as variances must be recorded with the <br />County. As such, the City should clearly state all conditions in its resolu- <br />tion to approve the request.
