MINUTUS PLANNING COMMISSION JUNI; 8, 2006 Knudsen stated that there is a lot of due diligence that will have to be done relative to drainage. There could be significant changes in the plat based on the findings of wetland impact statements, etc. Knudsen noted that the City wants to understand the concerns of the neighborhood at Chis point. Nothing will happen with this concept development unless it moves to the next phase. If it does, there will be another public hearing as well as in- depth review of engineering details. Sharon Sculley stated Chat their family has tried Co impress on people that their property was once dry land. She indicated that even best practices does not always go as planned, and was concerned that the onus is on the properCy owner Co protect their property pitting one owner against another. John Sculley, 3000 LaBore Road, reported that over the years his family has had discussions with the City Council on the issue of how development has impacted the wetland area on his property. He reported that Council members have walked through his properCy and have seen the changes on the Maplewood/Little Canada border. He further noted that anyone who grew up in the area has seen the changes as well. Sculley reported that the development over the years has changed the direction of the natural run-off. He pointed out the holding pond that was constructed at the south end of this area that also impacted the natural run- off. Sculley stated that as a result of what has occurred over the years, he has very little faith in engineers and those people who are supposed Co oversee projects to ensure that they are done correctly. Sculley felt that a property owner should be able to do whatever they desire with their property within reason, but pointed out that as a result of surrounding development he now has 15 acres of property that he can only get to by four-wheeler. Sculley felt that this is the result of engineering that was reviewed by Maplewood, Ramsey County, and the State of Minnesota. Sculley stated that his hope for Mr. Johnson's concept development is that Che City insists run-off is controlled from the north Co Che south. Sculley felt there was no reason a property owner should have their property devalued because engineers will not listen to the people who live in the area. Knudsen stated that he agrees with Mr. Sculley's commenCS and indicated Chat Che Commission wants to hear the comments and concerns of the neighborhood. However, the review is conceptual at this point and there has not been a lot of detail analysis done as of yet. 9
