Minnesota Pollution Control Agency <br />To Whom It May Concern: <br />Nnmern'us inquiries reg=rnl'.np the dnleg tion of d i-hC.r` t- <br />open burning permits have been received by the :Vinnesot< <br />Pollution Control Agency. This letter is intended to provide <br />information concerning delegation of that authority. <br />Open burning in the State of Minnesota is regulated under the <br />provisions of Minn. Rule APO 8 "Open Burning ". In accordance <br />with section (f)(3) of the rule, a person or persons designated <br />by 'a county board of commissioners, or either a fire chief or a <br />person designated by a township or city, may accept applications <br />and issue open burning permits upon authorization by the <br />Minnesota Pollution Control Agency. <br />In order to receive this authorization, the governmental unit <br />must submit a written request to the Director, Division of Air <br />Quality, Minnesota Pollution Control Agency, requesting the <br />authorization. As part of the formal request, a copy of the <br />meeting minutes indicating the motion passed to designate a <br />person (name and position) to be approved by the Director and a <br />copy of an ordinance adopting Minn. Rule APO 8 by the <br />governmental unit are also requested.
