With the exception of proposed Tract B <br />all lots also meet the front yard setbacks. Tract B technically does not <br />meet the required setback because of the exception lot which protrudes into <br />its frontage. In our opinion, a variance is required for this situation to <br />be legally acceptable. Such a variance appears justifiable and therefore <br />would be recommended. <br />RECOMMENDATION <br />It is our conclusion that the proposed layout conforms to ordinance require- <br />ments of the City to the greatest extent possible. In the case of the <br />proposed Tract 8, a variance is required, but appears justifiable. <br />The division of land should be prepared in a proper plat form according to the <br />Zoning Ordinance.
