PAUL, MINNESOTA 55102 <br />Please find enclosed for your review a copy of Chapter 490, <br />1982 Laws. As you will see on page 432, Minn. Stat. Section 462.357 <br />now provides that a municipality may regulate the width and type of <br />foundation of buildings and structures. This amendment by the 1982 <br />Legislature, however, also provides that a zoning regulation may <br />not prohibit manufactured homes "that comply with all other zoning <br />regulations." However, to the extent that there are width require- <br />ments and requirements as to the type of foundation, the manufactured <br />homes would have to comply with those requirements. <br />Other cities, such as Maplewood, have addressed this question <br />by enactment of additional ordinances relating to width and founda- <br />tion. <br />Also find enclosed in this regard a copy of Blaine Ordinance <br />No. 769. The underlined portions of that ordinance relate to <br />issues in addition to width and foundation. <br />My review of the Zoning Code indicates that the City does not <br />presently have such requirements in the Zoning Code. If the <br />Council anticipates amending the Zoning Code the sections that <br />should be reviewed to possibly include such amendments would be <br />Sections 903.040, 905.060, 906.060, 909.060, and 908.020, adding <br />to the R -4 permitted uses "or manufactured homes, built in con- <br />formance with Minn. Stat.
