PAUL, MINNESOTA 55102 Please find enclosed for your review a copy of Chapter 490, 1982 Laws. As you will see on page 432, Minn. Stat. Section 462.357 now provides that a municipality may regulate the width and type of foundation of buildings and structures. This amendment by the 1982 Legislature, however, also provides that a zoning regulation may not prohibit manufactured homes "that comply with all other zoning regulations." However, to the extent that there are width require- ments and requirements as to the type of foundation, the manufactured homes would have to comply with those requirements. Other cities, such as Maplewood, have addressed this question by enactment of additional ordinances relating to width and founda- tion. Also find enclosed in this regard a copy of Blaine Ordinance No. 769. The underlined portions of that ordinance relate to issues in addition to width and foundation. My review of the Zoning Code indicates that the City does not presently have such requirements in the Zoning Code. If the Council anticipates amending the Zoning Code the sections that should be reviewed to possibly include such amendments would be Sections 903.040, 905.060, 906.060, 909.060, and 908.020, adding to the R -4 permitted uses "or manufactured homes, built in con- formance with Minn.
