NORTHWEST ASSOCIATED CONSULTANTS INC. <br />February 15, 1983 <br />Mr. Tom Sweeney <br />Sweeney, O'Connor & LeMay <br />Northern Federal Building, Suite 350 <br />6th and Wabasha <br />St. Paul, Minnesota 55102 <br />RE: Little Canada - Heather Oaks PUD <br />File No: 758.09 - 82.08 <br />Dear Tom: <br />During our initial meeting with the developer for Heather Oaks, Mr. Chlebeck <br />had a question relative to the notification which must be sent out regard- <br />ing the zoning actions on this matter. Apparently within the 350 foot mailed <br />notice area, a condominium project exists. Mr. Chlebeck's question is whether <br />the formal written notice can go simply to the Homeowners Association or <br />whether the City must advise each individual owner. <br />Another question which gets into legal aspects of the project is that a water <br />line will be run through the area on what, at this point, is proposed to be <br />a private road. A question which Mr. Carley and Mr. Chlebeck raised is whether <br />this line should be public. This would apparently be a policy matter relative <br />to public safety more than anything else, however, maintenance and administra- <br />tion are also a concern. Should it be decided that a public line is necessary <br />or the best approach, an easement for utility placement and access should be <br />relatively simple, as the line is located within the proposed private street. <br />Should the easement be provided, shutoffs could be reached quite easily by City <br />staff should there be reasons to terminate an individual unit's water service. <br />The sewer line also which will serve the project at present is a public line <br />running to the rear of the development. While the extensions which are <br />necessary into the property could be public and placed within easements, I see <br />no reason for such a requirement. However, should you have questions as to this <br />procedure, I would appreciate your raising them to me. <br />Please contact me on this matter, should you have questions.
