MINUTES <br />City Council <br />March 11, 1981 <br />The Planner also informed the Council that the City code says that <br />curb cuts should be at least 60 feet from a corner. The A & W's curb <br />cut is 10 to 20 feet from the corner. <br />Mr. Anderson stated that the A & W will open on Saturday and they <br />would like to begin construction as soon as possible. <br />Councilman Fahey indicated that the Council can approve a building <br />permit subject to the proper plans being submitted and a performance <br />bond being submitted for the removal of the structure should the <br />idea not work out. <br />Mrs. Scalze stated that if the structure stays, the curb cuts the City <br />wants should be made, otherwise the building would have to come down. <br />Mayor Hanson commented that if A & W does not put up the structure they <br />are proposing, then the City would do nothing about the curb cuts. <br />Hanson questioned the situation that because they want to make a change <br />in their building, the City penalizes them. <br />The Planner indicated that the driveway is presently too close to the <br />corner and it is a hazardous situation. <br />Mr. Anderson indicated that they do not object to the curb cut, they <br />would just like a year to evaluate the business. <br />Mrs. Scalze stated that she would like to see the curb cuts taken care <br />of right now. <br />The Engineer stated that the A & W will have to deal with the Highway <br />Department regarding the curb cuts. The Highway Department will indicate <br />where the new curb cut should go. <br />Mr. Broden requested that the situation regarding the success of the <br />business and the curb cuts not have to be evaluated until April of 1982. <br />This will give Mr. Broden a full season to make an evaluation :'n the <br />success of the experiment. <br />Fahey stated that curb cuts should be required at some point to conform <br />with the City's ordinance. <br />Mrs. Nardini introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 81 -3 -116 - APPROVING THE ADDITION TO THE A & W <br />BUILDING AS PRESENTED BY MR. RICHARD ANDERSON CONTINGENT UPON <br />THE REQUIREMENT OF A PERFORMANCE BOND IN THE AMOUNT OF $500 <br />AND UPON MR. BRODEN APPEARING BEFORE THE COUNCIL ON OR BEFORE <br />APRIL 1, 1982 TO REPORT TO THE COUNCIL HIS PLANS FOR A <br />PERMANENT STRUCTURE AND HIS PLANS FOR CURB CUTS AND IN THE MEANTIME <br />MR. ANDERSON WILL SUBMIT ACCURATE PLANS TO THE CITY PLANNER <br />WHO IN TURN WILL REFER THESE PLANS TO MRS. NARDINI AND THE CITY <br />BUILDING INSPECTOR <br />89 <br />
