HAWKE
February 22, 1983
Mr. Thomas Sweeney
Attorney at Law
350 Northern Federal Building
Saint Paul, MN 55102
Re: Little Canada Day Care Center/
Planned Unit Development
Dear Mr. Sweeney:
As I mentioned the other day, Mr. Krejci's main concern
over Paragraph 10 of the Planned Unit Development Agree-
ment is that it appears to be too broad, and is not
limited to disputes or disagreements between the City
and Little Canada Day Care, Inc., or Mr. and Mrs. Krejci.
Due to those concerns, it is hoped that the following
language might be acceptable to the City, or at least
language that is more restrictive as to the liability of
the Krejcis for any expenses involved in the defense, en-
forcement or administration of the Planned Unit Agreement.
The following language is suggested:
10. The parties agree that in the event there is a
a dispute between them and either party incurs
legal expenses and /or court costs in seeicdag to de-
fend or enforce all or any portion of this Agreement
against the other party, the prevailing party in any
such dispute shall be reimbursed for all such costs
and fees by the other party.
Please consider this proposed revision and let me know if
it, or some other revision, would be acceptable.
Very truly yours,
435 HAMM BUILDING
SAINT PAUL, MINNESOTA 55102
(612) 291 -8015
CITY r :F
LITTLE CA. ;',if.
