Peter Street <br />Suite 270 <br />St. Paul, MN 55102 <br />RE: Little Canada - Rezonings <br />FILE NO: 758.09 - 88.55 <br />Dear Mr. Weltzin: <br />The purpose of this letter is to inform you of the effects of the <br />proposed rezoning of the County's property in Little Canada from <br />I -1 to B -3, General Business District. The currently use of the <br />property, as indicated to me by your staff and verified by site <br />inspection on 8 September, is the stockpiling of various <br />construction materials such as gravel. Outdoor storage as a <br />principal use of land is a conditional use in both the Light <br />Industrial and General Business Districts in Little Canada. As <br />such, the rezoning would not affect the status of the County's <br />activity. <br />Since outdoor storage requires a conditional use permit (C.U.P.) <br />under either district, the use would currently be considered non- <br />conforming as the County does not have such a permit. As a non- <br />conforming use, the activity is "grandfathered in ", that is, <br />allowed to continue, but only in its current form and intensity. <br />Once a non - conforming use is lessened or discontinued, it may <br />only be re- established in conformance with the Zoning Ordinance. <br />Therefore, once some or all of the stockpiled materials are <br />removed, they may not be replaced and no new materials may be <br />added, except by Conditional Use Permit. <br />Page 45 <br />4601 excelsior blvd., ste. 410, minneapolis, mn 55416 (612) 925 -9420 <br />
