The site in question is
located at 100 South Owasso Boulevard and is zoned "I -1" Light
Industrial District. The required rear yard setback in this
district is 20 feet. The proposal calls for a variance of
approximately 3 feet to allow a rear yard setback just shy of 17
feet.
Recommendation:
This proposal does not meet the strict intent of the City's
variance criteria for approval. However, the request does
propose to maintain the existing nonconforming setback. Because
the applicant is not requesting an increase in the present legal
non - conforming setback but does not meet Ordinance criteria for a
variance we find this to be a policy decision the City must make.
Attached for reference: Exhibit A - Site Location
Exhibit B - Site Plan
Page 83
4601 excelsior blvd., ste. 410, minneapolis, mn 55416 (612) 925 -9420
