In a prior letter sent to Mr. Shryer, <br />the developer of the property, the City of Little Canada stated that <br />no more certificates of occupancy would be issued to Mr. Shryer until <br />he had both met with the officials of your city, and had begun to <br />comply with the terms of his development contract. To date, we are <br />aware that he has net with various city officials; and that he has <br />made promises to comply with the agreement. We also acknowledge that <br />he has done some of the road resurfacing required, and that he has <br />worked on the retaining walls. However, there has been no visible <br />progress made in several other key areas, including the landscaping. <br />His "promise" to comply with the development agreement is rather <br />pointless, as he was already legally obligated to perform these <br />items. We do not feel that a mere "promise to comply" with the <br />development agreement is the same as actually complying with it; we <br />further do not feel that his promises are a sufficient basis for <br />"letting him off the hook" by allowing him Certificates of Occupancy. <br />It is now my understanding that these certificates will now be <br />allowed, based upon the little that he has done for the last two <br />months, and his promises to do more. We therefore are requesting to <br />be placed upon the agenda for the next available council meeting, and <br />to have the various officials from the City explain why they do not <br />feel obligated to enforce both the terms of the development <br />agreement, and their subsequent letter to Mr. Shryer.
