SSOCIATES,IN' <br />tonsuWng Englnrm —land Sv,v.yen <br />500 West Highway 96 <br />St. Paul, Minnesota 55112 <br />484 -3301 <br />September 28, 1988 <br />SUMMARY REPORT ON THE THIRD RAMSEY COUNTY PILOT EROSION AND <br />SEDIMENT CONTROL PROGRAM COMMITTEE MEETING HELD ON 9 -27 -88 <br />In order to standardize methodologies and procedures --by--which ersosion <br />and sediment control are practiced in Ramsey County; The Ramsey Soil <br />and Water Conservation District has introduced the Ramsey county <br />Coordinated Erosion and Sediment Control Pilot Program. This program <br />if adopted, will be enforced at the local level through a municipal <br />ordinance (enclosed).. The series of meetings that are being conducted <br />by Ramsey Soil and Water Conservation District have been focusing on <br />this ordinance. <br />The District has to adopt the program by January 1, 1989, and the water <br />management organizations by January 1, 1990; cities and municipalities <br />were recommended to adopt the program simultaneously with the water <br />management organizations. <br />A brief summary of the discussion held on Tuesday concerning the <br />model ordinance are outlined below: <br />Section 3.6 (2) was revised to include telephone and electric <br />utility work involving land disturbance of more than 10,000 <br />square feet of land in the classification of "Land Disturbance <br />Activity ". It was suggested that electric utility work <br />include cable television and fiber optic cables. <br />Section 9.0 of the model ordinance requires an escrow fund <br />from a developer to assure the adherence of the project to <br />the Erosion and Sediment Control Plan. By requiring an <br />escrow fund rather than a performance bond of surety, the <br />committee believes to have a better enforcing capacity. <br />Concerns were raised about developers abandoning the erosion <br />control plan, since they have already paid to the escrow <br />fund; and transferring the burden of implementing the <br />erosion and sediment control plan to the permitting agency. <br />To resolve this problem, it was suggested that the permitting <br />agency determine the amount of escrow fund to include a penalty <br />above the cost of the installation of the erosion and sediment <br />control practices. <br />Section 7.0 of the model ordinance requires that a developer <br />dedicate an easement to the city for any permanent erosion <br />and sediment control practice that remains after the land <br />disturbance activity is complete.
