Ostrow
Sweeney, O'Connor & Bor
Prrn: sional Association
Attc:_ neys at Law
Suite 1200
One Capital Centre Plaza
386 North Wabasha Street
St. Paul, Minnesota 55102
December 28, 1987
Mr. Joseph G. Chlebeck
City Clerk
515 Little Canada Road
Little Canada, MN 55117
Re: Purchase of Twin Lake Boulevard
Our File No. 4675
Dear Joe:
.elephone
2) 222 -2541
As we have discussed on numerous occasions in the last five
years, the City of Little Canada is in the process of purchasing
certain tax - forfeited land within the City of Little Canada from
the State of Minnesota by virtue of a Certificate of Sale of
Forfeited Lands, pursuant to Minn. Stat. Chapter 282, dated
January 19, 1983. The Certificate of Sale establishes the
purchase price as $15,000.00, with the first installment of
$1,500.00 payable on January 19, 1983, and the balance of
$13,500.00 in ten equal annual installments of $1,350.00 payable
on or before the 19th day of January, 1984 and each year
thereafter until the entire purchase price has been paid. In
early 1983, our firm, as special attorney for the State of
Minnesota, filed an Application to Register Title to the land
that was being purchased in the Ramsey County District Court. At
that time and in the following years, we have been assured by the
office of the Examiner of Titles that the Application to Register
Title would be finally acted upon in a timely fashion so that any
questions as to the marketability of the title to be conveyed by
the State of Minnesota to the City of Little Canada would be
resolved prior to payment of the full purchase price.
Unfortunately, as of December 11, 1987, in our last
conversation with the Examiner of Titles, namely Bob Beutel, the
Examiner once again informed us that the Application is being
processed by one of his personnel in due course. The person to
whom the file has been assigned has recently had severe physical
problems which have necessitated by -pass surgery. The Examiner
informs us that that person will continue to handle this file and
will complete the matter on his return, whenever that may be.
Therefore, it does not appear that we can even estimate when this
matter would be completed.
Page 6
