MINUTES <br />PLANNING COMMISSION <br />JANUARY 12, 2006 <br />McGraw pointed out that the Galba children are young, but as they grow <br />older and until landscaping has grown to provide a substantial barrier <br />between the street and sports court, there is potential for pucks flying out <br />onto Edgerton Street. McGraw expressed concern for the Galba's relative <br />to liability issues. McGraw noted Galba's willingness to have a <br />professional landscaper look at the situation. He felt once adequate <br />landscaping was in place, the impact of the sports court would be far less. <br />Duray asked if the Text Amendment provided the City the ability to require <br />fencing up to 10 feet in heighC. The Planner stated that that was correct. He <br />noted that the City could impose a condition that the CUP be revisited in <br />one year to review the impact of the sports court. <br />Rheaume compared the fact that the hockey board would be up all year to <br />someone parking their snowmobile in the fronC yard all winter. Rheaume <br />again stated that he would have less concern with the sports court if the <br />boards were up only during the winter months. <br />Galba noted that they would plan to use the sports court for roller hockey <br />and the board would be needed. Galba felt that once the boards were <br />painted to match his house and the landscaping in place, the sports court <br />would not be noticeable. <br />Duray stated that he had concerns that the Text Amendment would open <br />this use up to others in the City, but given the requirement for a CUP and <br />the fact that the City can impose conditions such as landscaping, there is <br />protection for the City. Duray felt that in this case an extensive landscaping <br />plan is necessary. <br />Hall recommended approval of the Text AmendmenC creating a Conditional <br />Use Permit to allow for recreational uses in a front yard as recommended by <br />the City Planner. <br />Motion seconded by Barraclough. <br />Motion carried 7 - 0. <br />Hall recommended approval of a Conditional Use Permit allowing a <br />recreational use (sports court) in the front yard of the Mall Galba property at <br />2850 Edgerton Street subject to compliance with the recommendations of <br />the City Planner as outlined in his report dated January 9, 2006, and subject <br />to submission and approval of a detailed landscaping plan and lighting plan <br />for the sports court. <br />-10- <br />
