3 <br />MINUTES <br />• City Council <br />Sept. 14, 1983 <br />Water On <br />Arcade <br />(Cont.) <br />Schletty <br />Woods <br />Out lot <br />Clarification <br />Agenda <br />Item No. 13 <br />Easement • <br />Purchase <br />Agreement <br />Sleepy Hollow <br />The Attorney stated that if Maplewood does not want to enter into <br />a joint powers agreement, the City can contract with the property <br />owners and collect an amount equal to the assessment through a <br />contract. <br />Mr. Hanson stated that if the City approves the extension, it would <br />be in the interest of the City to put some control in so that Little <br />Canada does not end up watering the rest of Maplewood. <br />Nardini stated that the City specifically does not want to provide <br />water to the Anderson development because of the multiples that <br />are proposed. <br />The Attorney stated that the City has the power to extend its water <br />to the point that it does not want to extend it any further. <br />Mrs. Scalze asked if Mr. Anderson could buy one of Frattalone's lots <br />and take water from it. Mr. Glanzer commented that this is prohibited <br />under the City's ordinance. Mr. Fahey stated that the City must <br />maintain control of that water line. <br />Mr. Hanson pointed out that Outlot A of Schletty hoods appears to <br />be landlocked. <br />The clerk commented that the City cannot allow this to be landlocked. <br />Mr. Chlebeck reported that Mr. Schletty will give up Tract C and <br />this can he made part of the Outlot. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 83 -9 -438 - CLARIFYING OUTLOT A <br />OF SCHLETTY WOODS SO THAT THE OUTLOT CONSISTS <br />OF OUTLOT A AND TRACT C <br />The foregoing resolution was duly seconded by Mrs. Nardini. <br />Ayes (5) Fahey, Nardini, Hanson, Forsberg, Scalze. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book Nc. 9, Page 482. <br />The City Attorney submitted to the Council for approval a purchase <br />agreement for an easement for the Sleepy Hollow drainage project. <br />The cost of the easement is $453.70. There is also $800 provided <br />for the possible removal of three trees. If just some or noreof the <br />trees have to he removed, the $800 figure will be adjusted accordingly. <br />r <br />Pare -1'1- <br />
