Vick <br />DATE: 5 July 1984 <br />RE: Richards - Variance Request <br />FILE NO: 758.09 - 84.23 <br />BACKGROUND <br />Mr. Richard of 510 East County Road D has applied for a variance for a <br />fence and swimming pool within the required front yard setback. The <br />property is zoned R -1 and the required front yard setback is 30 feet. <br />A six foot high fence comes within 5 feet of the front lot line and the <br />swimming pool is within 15 feet. <br />ISSUES AND ANALYSIS <br />The Little Canada Zoning Ordinance outlines the conditions for which <br />a variance may be granted as follows: <br />Section 922.010.C.1. ...the proposed action will not: <br />a) Impair an adequate supply of light and air to adjacent property. <br />b) Unreasonably increase the congestion in the public street. <br />c)- Increase the danger of fire or endanger the public safety. <br />d) Unreasonably diminish or impair established property values <br />within the neighborhood, or in any way be contrary to the intent <br />of this Ordinance. <br />e) Violate the intent and purpose of the City Comprehensive Plan. <br />and Section 922.010.C.2. ...it can be demonstrated that: <br />a) Special conditions and circumstances exist which are peculiar <br />to the land, structure or building involved. <br />b) Literal interpretation of the provisions of this Ordinance would <br />deprive the applicant of rights commonly enjoyed by other properties <br />in the same district under the terms of this Ordinance. <br />c) The special conditions and circumstances do not result from the <br />actions of the applicant. <br />d) Granting the variance requested will not confer on the applicant <br />any special privilege that is denied by this Ordinance to other <br />lands, structures, or buildings in the same district. <br />e) A genuine hardship exists in complying with the literal terms of <br />this Ordinance. <br />2 <br />4820 minnetonka boulevard, suite 420 minneapolis, inn 55416 612/925-9420 <br />
