NORTHWEST ASSOCIATED CONSULTANTS INC. <br />July 16, 1984 <br />Mr. Gene'Bunde <br />975 Beam Avenue <br />Little Canada, Minnesota 55109 <br />RE: Bunde Development Request <br />File No: 758.09 - 84.24 <br />Dear Mr. Bunde: <br />Pursuant to our phone conversation on 11 July, I had the opportunity to review <br />your letter of 9 July 1984 with the City staff and City Council the same <br />evening. The conclusion of these discussions was that two alternatives exist <br />to resolve your situation. The first would be to locate the proposed storage <br />building on your principal property where your residence is located. As such <br />the building would be classified as an accessory use and assuming it would <br />conform to setback requirements, no special processing or approval would be <br />required. <br />The second alternative, given your mortgage and contract for deed situation, <br />would be to file for a conditional use - planned unit development. While this <br />is stretching the use of the PUD, it appears to be the only legal method <br />whereby your objective can be achieved, short of actual resubdivision and <br />combination of the properties. Under the planned unit development approach, <br />assuming City Council approval, you would enter into a contract with the City <br />that once the contract for deed on the landlocked parcel was paid off, you or <br />any subsequent owner would proceed to file and record the combination with the <br />County. As part of the contract, a registered land survey would have to be <br />prepared.and included as a documented attachment. <br />Mr. Chlebeck has the necessary forms for the application of the conditional <br />use permit. This should not, however, be submitted prior to the preparation <br />of the site survey so that it can be submitted simultaneously. Assuming you <br />can file the application on or before 30 July, the matter will be considered <br />by the Planning Commission on 12 August 1984. Subsequently. a public hearing <br />on the matter would be held on 22 August. Your presence would be expected <br />at both meetings. <br />As I indicated to you previously, there are rational reasons for the process <br />which is involved. An attempt to "bend" the rules to allow the initial division <br />of land to accommodate all those involved is the basis of your present problem <br />and likely expense.
