NORTHWEST ASSOCIATED CONSULTANTS INC. <br />MEMORANDUM <br />TO: Little Canada Planning Commission <br />Little Canada Mayor and City Council <br />FROM: James Vick <br />DATE: 16 July 1984 <br />RE: Behr - Special Home Occupation <br />FILE NO: 758.09 - 84.29 <br />Jul 19 1984 <br />CITY OF <br />LITTLE CANADA <br />BACKGROUND <br />Mr. Behr has applied for a special home occupation permit for 2717 Noel Drive. <br />The property in question is zoned R -1, Single Family Residential. The proposed <br />activity includes the sale or trade of garden tractors, lawn mowers and <br />refrigerators. <br />ISSUES <br />The intent of the home occupation review is to prevent competition with business <br />districts and to provide a means through the establishment of specific standards <br />and procedures by which home occupations can be conducted in residential neigh- <br />borhoods without jeopardizing the health, safety and general welfare of the <br />surrounding neighborhood. The Zoning Ordinance lists general provisions which <br />identify standards for acceptable home occupations. Following is an evaluation <br />of these.requirements which conflict with the proposed home occupation: <br />1. No home occupation shall produce light glare, noise, odor or vibration <br />that will in any way have an objectionable effect upon adjacent or <br />nearby property. <br />The proposed use involves testing and demonstration of lawn tractors and <br />mowers which by its nature is excessively noisy. In addition, there <br />is a fork lift on the site used for moving appliances, which increases <br />the impact of noise. <br />2. Any home occupation shall be clearly incidental and secondary to the <br />residential use of the premises, should not change the residential <br />character thereof, and shall result in no incompatibility or disturbance <br />to the surrounding residential uses. <br />While it may be difficult to determine the dominance of residential or <br />commercial use, neighborhood complaints have demonstrated its in- <br />compatibility with the surrounding area. <br />q nk <br />2 <br />4820 minnetonka boulevard, suite 420 rninneapolis, mn 55416 612/925 -9420 <br />
