Special home occupations may be allowed to accommodate their parking <br />demand through utilization of on- street parking. In such cases where <br />on- street parking facilities are necessary, however, the City Council <br />shall maintain the right to establish the maximum number of on- street <br />spaces permitted and increase or decrease that maximum number when <br />and where changing conditions require additional review. <br />The property in question is located near the curve of Noel Drive. A <br />letter received from a resident in this neighborhood indicates congestion <br />created by cars, trucks and trailers parked on the street which are <br />associated with the business at the Behr residence <br />Following are five factors listed in the Zoning Ordinance which help determine <br />the possible adverse effects of the proposed activity: <br />1. The proposed action has been considered in relation to the specific <br />policiesand provisions of and has been found to be consistent with the <br />official City Comprehensive Land Use Plan. <br />2. The proposed site is or will be compatible with present and future land <br />uses of the area. <br />The proposed business is of an intensity as allowed in the "B -3 ", General <br />Business District. The site and surrounding properties are zoned "R -1" <br />and are residential in character. The proposed activity is not consistent <br />with the development of this area. <br />3. The proposed use conforms with all performance standards contained herein. <br />As demonstrated above, the proposed use is in violation of several per- <br />formance standards required by home occupations. <br />4. The proposed use will not tend to or actually depreciate the area in <br />which it is proposed. <br />A letter received from a neighbor documents that their home was evaluated <br />by realtors at below market value. Partial cause is speculated from the <br />blight caused by the proposed home occupation. <br />5. The proposed use can be accommodated with existing public services and <br />will not overburden the City's service capacity. <br />The proposed home occupation does not over burden the City's service <br />capacity. <br />
