CONT. <br />Tape no. to <br />OLD CODE <br />ORDINANCE NO. 103 <br />AN ORDINANCE »ta:DING THE LITTLE CANADA CODE <br />BY ADDING A NEW CHAPTER 916. EXCAVATION. REGULATING <br />AND CONTROLLING THE REMOVAL OF '..OIL AND NATURAL <br />MATERIAL. <br />THE COUNCIL OF THE VILLAGE OF LITTLE CANADA DOES HEREBY ORDAIN AS FOLLOWS: <br />Section 1. That the Municipal Code of Little Canada is hereby <br />amended by adding a new Chapter 916. EXCAVATION. to read as follows: <br />"916. EXCAVATION. <br />916.010. PERMIT REQUIRED. The extraction of sand, gravel. <br />black dirt or other natural material from the land by a person, firm or <br />corporation in the amount of 100 cubic yards or more shall be termed excava- <br />tion and shall require a permit. <br />916.020. EXCEPTIONS. It is intended hereunder to cover the <br />removal of natural materials from lands including such activity when carried <br />on as a business but shall not apply to basement excavation or other excavation <br />which is already covered by the Building Code or Zoning Code of this Village. <br />916.030. APPLICATION FOR PERMIT. Any person, firm or corporation <br />desiring • permit hereunder shall present an application on such form as shall <br />be provided by the Village Clerk containing the name and addressof the applicant, <br />the legal description of the land involved, the kind and quality of the material <br />to be removed, the depth to which It is to be excavated and the condition in which <br />the property is to be left after removal of such materials. Tie applicant <br />shall also furnish • plan for • finished grade which will not adversely affect <br />the surrounding land or the development of the Bite on which the excavation is <br />being conducted. <br />Section 2.
