ORDINANCE NO. 391 <br />Page 2 <br />SECTION 3. AMENDMENT. "Ire Code of the City of Cottage Grove, Minnesota" <br />shall be amended to add Section 28- 53(d)(10) as follows: <br />(10) Accessory Apartments. <br />a. Purpose. The purpose of this section is to permit the <br />installation of no.more than one accessory apartment in an <br />existing single family dwelling. Because this opportunity <br />is allowed in neighborhoods with established recreation <br />facilities, utility systems, parking, traffic patterns, and <br />architectural character, the installation and use of accessory <br />accessory apartments must be strictly controlled to avoid <br />adverse physical, social, economic, environmental, and <br />aesthetic impacts. By allowing only those accessory apartments <br />that are in compliance with all of the performance standards <br />of this section, the cbaracter and quality of existing <br />neighborhoods will be protected. <br />b. Permit Procedures: <br />1. Application Procedures. No one shall install an <br />accessory apartment without first having obtained <br />a permit from the Zoning Administrator. Application <br />for the permit shall be made on such forms) as may be <br />designated by the Zoning Administrator and shall be <br />accompanied by the required permit fee. <br />Within ten (10) working days after receiving the <br />application, the Zoning Administrator shall review <br />the application and inspect the property to determine <br />whether or not the proposed accessory apartment meets <br />the Performance Standards. (S)He shall deny or approve <br />the application based upon a statement of findings <br />relative to the standards. <br />If the decision is to approve the permit, a notice <br />of that intent shall be sent to all owners of <br />property within 350 feet of the applicant's property. <br />Written cculents will be requested. The Zoning <br />Administrator shall make the final determination <br />thirty (30) days after the notice is mailed. Notice <br />of the final determination shall be mailed to any <br />person t4 o suhnitted written ccnments during that <br />thirty (30) day period. The decision CO issue or <br />deny the pennit may be appealed to the Planning <br />Comnission. <br />2. Permit Renewal. The permit shall be renewed yearly, <br />subject to an inspection and the penult renewal fee. <br />Notification to neighboring property owners will not <br />be nude for the permit renewal. <br />-3.
