PAUL, MINNESOTA 55102
FEB 16 1984
CITY OF
LITTLE CANADA
Please find enclosed a copy of the Order Granting Partial
Summary Judgment, whereby Judge Poritsky of the Ramsey County
District Court has determined that the facility proposed by
Good Neighbor is a permitted use in a R -1 District.
The basis of the Court's decision is found on page 6 of
the Memorandum, wherein the Court states that "the Good Neighbor
home residents' living arrangements will constitute 'foster care'
and that they will comprise a 'family' within the meaning of the
Little Canada Zoning Ordinance."
I would recommend that I discuss this decision and the
alternatives available to the City with the City Council at a
closed meeting either before or after the Council meeting of
February 22, 1984. By that time, I will have discussed the
status of this matter with opposing counsel and co- counsel.
Very truly yours,
SWEENEY, O'CONNOR & LeMAY
Thomas M.
