NORTHWEST ASSOCIATED CONSULTANTS INC. <br />MEMORANDUM <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: 29 February 1984 <br />RE: Jenniges Lot Split and Variance Request <br />FILE NO: 758.09 - 84.04 <br />CITY APPLICATION //228 <br />BACKGROUND <br />Mr. James Jenniges of Jenniges Construction has applied for a lot split of <br />his parcel on Edgerton and a variance for lot width. The lot in question is <br />between Allen Avenue and LaBore Road on the west side of Edgerton. It is <br />367 feet deep and has 150 feet of frontage. A substandard structure of just <br />500 square feet sits 3.5 feet from the midpoint of the lot. In addition, a <br />well exists just across the midpoint line from the house. There is no City <br />water along Edgerton. The proposal calls for the parcel to be split so that <br />the southernmost lot would be just 65 feet wide. The other option is to <br />split the parcel into two 75 foot (conforming) lots and process a variance <br />from the side yard setback requirements for the house. <br />MAR 1 1984 <br />CITY OF <br />LITTLE CANADA <br />k <br />ANALYSIS <br />The Subdivision Ordinance lists methods which may be employed to allow for <br />variations from the exact requirements of the zoning district. Section 1010.010 <br />of the Subdivision Ordinance states that variances shall only be recommended <br />when it is found that: <br />a. That there are special and highly unique circumstances or conditions <br />affecting said property which are not common to other properties in the <br />City and that the strict application of the provisions of this <br />Ordinance would deprive the applicant of the reasonable and minimum <br />use of his land. <br />b. That the granting of the variance will not be detrimental to the public <br />health, welfare or injurious to other property in the territory in which <br />property is situated. <br />c.
