Commission <br />FROM: David Licht�i'✓ <br />DATE: 3 April 1984 <br />RE: Nardini - Demont Property Rezoning <br />FILE NO: 758.09 - 84.06 (CITY #227) <br />Based upon comments and suggestions received at the 28 March 1984 City <br />Council public hearing on the proposed rezoning, Mrs. Nardini has elected <br />to change the rezoning request being considered. In order to insure that <br />a compatible use is developed on the property, it is now proposed that the <br />easterly lot be rezoned from R -2 to Planned Unit Development (PUD). The <br />westerly parcel rezoning request remains a change from R -2 to B -3. <br />From the comments and concerns voiced, it would appear that the introduction <br />of a PUD adjacent to the existing single family homes will resolve the un- <br />certainty and incompatibility questions. Any development which is proposed <br />on the easterly parcel will require submission of plans and review by the <br />Planning Commission, public hearing and notice and approval by the City <br />Council. A PUD contract will subsequently be formulated and signed to <br />regulate activities and define use and requirements. While a somewhat <br />unusual application of the PUD concept, the rezoning of the easterly <br />parcel is recommended. It is further suggested that as part of action <br />taken on the PUD, that the City indicate its intent that the uses to be <br />allowed range up to commercial activities as generally defined by the B -3 <br />zoning district. Such activities, however, are to be ones which can exist <br />in an harmonious fashion with the adjacent single family development. <br />The rezoning of the westerly parcel to 6 -3 is seen as consistant with <br />surrounding zoning and commercial activities.
