ANALYSIS <br />Simple Subdivision: <br />Because this application involves the division of one parcel into <br />two, the Subdivision Ordinance specifies that the subdivides may <br />be relieved in "complying with any requirements of this Ordinance <br />that are deemed inappropriate ". This request appears to meet the <br />definition of a simple subdivision. <br />Lot Area and Requirements: <br />The R -1 District requires corner lots to have a minimum lot area <br />of 11,000 square feet. The proposed lot split will leave the <br />corner lot with a lot size of approximately 28,000 square feet of <br />area. All setbacks are met except for the side yard setback for <br />the garage. This is a legally non - conforming situation that is <br />not affected by the proposed division, however, because it is an <br />existing structure. The vacant parcel will have a lot area of <br />approximately 2.5 acres or 109,000 square feet, which exceeds the <br />required lot size of 10,000 square feet. <br />Grading and Drainage: <br />A site inspection conducted at this site revealed a substantial <br />change in grade elevation from west to east. It appears the <br />grade falls approximately three feet and that some filling will <br />have to take place to make the eastern lot a buildable one. A <br />grading and drainage plan should be submitted to the City <br />Engineer for review and approval. <br />Easements: <br />At least a six (6) foot drainage and utility easement must be <br />provided along all lot lines of both proposed parcels. <br />Park Contribution: <br />Because this division will create an additional parcel, the <br />Little Canada Parks Commission should review the proposal and <br />determine if a contribution to the park fund is necessary. <br />Future Subdivision: <br />Due to the size of the vacant parcel (109,000 square feet) <br />created by this proposed subdivision, it is possible that this <br />parcel could be subdivided to create more lots in the future. <br />The Planning Commission may want to require Mr. Salak to provide <br />a concept sketch illustrating the intended use of this east <br />parcel. <br />Page 28 <br />
