1988 <br />ANIMAL CONTROL SERVICE CONTRACT <br />THIS AGREEMENT, made and entered into this 1st day of October, <br />1987, be and between Animal Control and Management, Inc., a Minnesota <br />corporation hereinafter referred to as ACM, and the CITY City of Little Canada <br />a municipal corporation, County, Minnesota, hereinafter referred <br />to as "CITY ". <br />WITNESSETH: That ACM, in consideration of the covenants <br />and agreements of CITY hereinafter contained, hereby covenants with CITY <br />that ACM will provide Animal Control Service to CITY pursuant to the <br />following provisions: <br />1. That ACM shall provide pick up service of animals in <br />CITY in a vehicle appropriate for the transportaion of <br />small animals. On -call pick up service shall be provided <br />Monday through Friday, 8:00 a.m. to 5:00 p.m., and <br />Saturday, 8 :00 a.m. to 12:00 noon, Sunday 12:00 noon to <br />4:00 p.m.. Standby emergency service shall be provided <br />at no extra charge per request of CITY's law enforcement <br />agency and /or previously specified official of CITY. <br />After 10:00 p.m. there will be a $10 charge per pick up. <br />2. That ACM shall provide limited patrol for the public and <br />private street of CITY during regular patrol hours for <br />the pick up of animals found to be in violation of CITY's <br />ordinances. Includes 10 hours of patrol service. <br />3. ACM agrees that patrolling shall be done by competent <br />personnel trained in the handling of animals. ACM shall <br />not forcibly take an animal from any person unless that <br />person's animal is in violation of CITY ordinance and ACM <br />may request assistance of a regular officer of the CITY <br />at their discretion. <br />4. That ACM shall equip, service and maintain all vehicles <br />used for Animal Control Service with two -way radios or <br />other communication equipment. <br />5. Pursuant to Minnesota Statues, ACM shall impound all animals <br />picked up in CITY at its Animal Shelter located at 1283 <br />Hammond Road, Town of White Bear (Township), Minnesota. <br />Said animals shall be confined in a humane manner for a <br />period of not less than five (5) business days or until <br />claimed by an owner. Animals not claimed before the <br />expiration of five (5) business days shall become the <br />property of ACM. If an animal is not so claimed, ACM may <br />dispose of said animal in a humane manner, pursuant to <br />Minnesota Statue <br />6. That an impoundment fee, per City Ordinance, per animal, shall <br />be retained by ACM. <br />7. That ACM shall provide euthanasia service to CITY at no <br />additional charge. Said service shall be administered by <br />qualified personnel and the disposal of animal carcasses <br />shall be performed as required by Minnesota Statute <br />Section 35.71 Subd 3, at no additional charge as long as <br />current facility is operational. <br />Page 12 <br />
