1989 <br />ANIMAL CONTROL SERVICE CONTRACT <br />THIS AGREEMENT, made and entered into this 1st day of January <br />1989, by and between Animal Control and Management, Inc., a Minnesota <br />Corporation hereinafter referred to as "ACM ", and the CITY, City of <br />Little Canada, a municipal corporation, Ramsey County, Minnesota <br />hereinafter referred to as "CITY ". <br />W1TNESSETH: That ACM, in consideration of the covenants and <br />agreements of CITY hereinafter contained, hereby covenants with CITY <br />that ACM will provide Animal Control Service to CITY pursuant to the <br />following provisions: <br />1. That ACM shall provide pick up service of animals in CITY <br />in a vehicle appropriate for the transportation of small <br />animals. On -call pick up service shall be provided Monday <br />through Friday, 7:00 a.m. to 7:00 p.m. Hours will ' <br />fluctuate for pick up services on Saturday's, Sunday's <br />and holiday's. Emergency services only on New Year's <br />Day, Easter Sunday, Thanksgiving Day and Christmas Day. <br />Standby emergency' service shall be provided at no extra <br />charge per request of CITY"s law enforcement agency and /or <br />previously specified official of CITY. After 10:00 p.m. <br />there will be a $25 charge per pick up. Includes 10 <br />hours per week of patrol service. <br />2. That ACM shall provide limited patrol for the public and <br />private streets of CITY during regular patrol hours for <br />the pick up of animals found to be in violation of CITY's <br />ordinances. <br />3. ACM agrees that patrolling shall be done by competent <br />personnel trained in the handling of animals. ACM shall <br />not forcibly take an animal from any person unless that <br />person's animal is in violation of CITY ordinance and <br />ACM may request assistance of a regular officer of the <br />CITY at their discretion. <br />4. That ACM shall equip, service and maintain all vehicles <br />used for Animal Control Service with two -way radios or <br />other communications equipment. <br />5. Pursuant to Minnesota Statutes, ACM. shall impound all <br />animals picked up in CITY at its Animal Shelter located <br />at 1283 Hammond Road, White Bear Township, Minnesota. <br />Said animals shall be confined in a humane manner for a <br />period of not less than five (5) business days or until <br />claimed by an owner.
