iNUTES Jity Council January 27, 1982 Mrs. Scalze stated that she was not in favor of automatically granting the deferrments to any senior citizen requesting one. Scalze commented that some seniors could be millionaires and still get deferrments. Mr. Fahey suggested that a senior citizen could file an affidavit on their income with the City Clerk and the Clerk could report to the Council whether or not the senior mets the requirements for a deferrment. In that way, the Council would not have to know the seniorb assets. Fahey also stated that he did not believe the deferrments should be granted solely on the basis of age, but there should be a geniune hardship present in order for the deferrment to be granted. Mr. Forsberg felt the deferrment policy should remain as it has previously been handled. Mr. Forsberg stated that the senior citizen may need his money for an illness or a nursing home. Hanson stated that the City is not in that bad of a financial situation that the policy could not remain as is for senior citizen deferrments. Fahey suggested that the senior could just file an affidavit stating that his annual payment for the assessment exceeds 2% of his adjusted gross income. No figures would have to be disclosed. Mrs. Scalze stated that the City could also discuss the situation of a young family that could not afford its assessment. Fahey agreed that there could be the situation of a young family without much money and a senior citizen with a lot of money. The Attorney suggested that the Council handle the situation by Council resolution rather than ordinance. A resolution is easier to amend and there is no publication requirement. Mr. Fahey introduced the following resolution and moved its adoption: RESOLUTION NO. 82 -1 -48 - ADOPTING A SENIOR CITIZEN DEFERRED ASSESSMENT POLICY AS OUTLINED IN THE CITY ATTORNEY'S LETTER DATED JANUARY 21, 1982 BEGINNING WITH THE STATEMENT IN THE THIRD PARAGRAPH ON PAGE TWO OF THAT LETTER: ^The City Council of the City of Little Canada determines that deferral of special assessments for certain senior citizens is in the public interest, and it is necessary that the City Council establish its general policies and guidelines for granting said deferrals of special assessments for senior citizens; therefore, the City Council endorses the principle of deferment of special assessments for certain senior citizens, where the payment of said special assessments would constitute a hardship; the City Council's consideration of the application for granting deferments of special assessments shall be based upon the following factors: PAGE -27- Page -11-
