�t <br />2<54 <br />MANUFACTURED HOME PARKS: SHELTER OR EVACUATION PLAN: Manufactured <br />home park licensed prior to March 1, 1998, presently must have a plan in place for the <br />sheltering or safe evacuation of residents or have made a good faith effort to do so. <br />Minn. Stat. 5 327.20, subd. 1(6) (1986); park by March 1, 1989, must have shelter <br />constructed on own site or have plan approved by that date or will violate Minn. Stat. <br />5 327.20, subd. 1(7) (1986); city may enforce provisions by prosecution for <br />misdemeanor or bring private civil action. Minn. Humphrey, III, you set forth <br />substantially the following: <br />FACTS <br />There is located within the City of Fridley (hereinafter the "city ") a <br />manufactured home park containing ten or more manufactured homes <br />licensed prior to March I, 1988 (hereinafter the "park "). The owners of the <br />park have filed a plan for the sheltering or the safe evacuation of the <br />residents of the park with the city pursuant to Minn. Stat. 5 327.20, <br />subd. 1(6). The city has not approved the plan_as filed and, in fact, has <br />determined that the plan is not adequate. <br />QUESTION ONE <br />is the park in violation Of Minn. Stat. 5 327.20, subd. 1(6) at this <br />time? <br />OPINION <br />Prior to March 1, 1989, the park is governed by Minn. Stat. 5 327.20, subd. 1(6) <br />(1986). That subdivision requires a manufactured home park to provide for a plan for <br />the sheltering or safe evacuation of the residents in times of severe weather <br />conditions. The plan is to be developed with the assistance and approval of the <br />municipality. Nothing in the statute requires the Department of Health (hereinafter <br />Page 21 <br />
