Resolution No. 88 -8 -351: <br />Declared no action to be taken by City to require Fina <br />to bring current sign into conformance pending further <br />study and action by Council. <br />11/23/88- Ordinance No. 308: <br />Unanimous Council decision to amend the Sign Ordinance <br />to delete the portion whereby a change in ownership or <br />franchise would require non - conforming sign to be <br />brought into conformance. However, should site <br />improvements occur that are valued at more than 50 <br />percent of the existing fair market value of the site, <br />as determined by the City Assessor, all signage must be <br />brought into conformance. <br />Ordinance Number 308 resulted from the City Council's review of <br />staff research into other Cities' policies regarding non- <br />conforming signage. <br />Variance Criteria: <br />As mentioned previously, a variance from the terms of the Zoning <br />Ordinance, shall not be granted unless it can be demonstrated <br />that: <br />a. Special conditions and circumstances exist which are <br />peculiar to the land, structure, or building involved. <br />(1) Special conditions may include exceptional <br />topographic or water conditions or, in the case of <br />an existing lot or parcel of record, narrowness, <br />shallowness, insufficient area or shape of the <br />property. <br />(2) Special conditions and circumstances may not be <br />primarily economic in nature. <br />b. Literal interpretation of the provisions of this <br />Ordinance would deprive the applicant of rights <br />commonly enjoyed by other properties in the same <br />district under the terms of this Ordinance. <br />c. The special conditions and circumstances do not result <br />from the actions of the applicant. <br />d. Granting the variance requested will not confer on the <br />applicant any special privilege that is denied by this <br />Ordinance to other lands, structures, or buildings in <br />the same district. <br />Page 36 <br />
