nonconforming structures, uses and sites. All nonconforming <br />situations legally existing are allowed to continue in the same <br />manner indefinitely. However, nonconforming situations must be <br />brought into conformance when specifically outlined happenings <br />occur. The City does not want to perpetuate nonconforming <br />circumstances. <br />The City Ordinance was established to avoid granting special <br />privilege to particular properties. With these guidelines, it <br />would appear approving this variance request would contradict the <br />intent of the Ordinance. <br />e. Hardship <br />There does not appear to be a genuine hardship impeding the <br />applicant's property or intended use at this location. <br />RECOMMENDATION <br />Based on the lack of qualifications relating to established <br />variance criteria including, but not limited to, the absence of <br />special or unique circumstances and genuine hardship, we see no <br />justifiable reason to grant this variance request. Information <br />throughout this report outlines administration of the City <br />Ordinance dealing with nonconforming situations.
