MeMENOMY &SEVERSON <br />A PROFESSIONAL ASSOCIATION <br />AT"PO R N I:IB AT I.AW <br />Page Four <br />Little Canada Planning Commission <br />February 28, 1989 <br />gasoline station at the northeast corner of I -694 and Rice Street <br />has a pylon sign estimated to be 40 feet high). <br />As Fina must directly compete with all four of these other freeway <br />fronting stations, it is respectively submitted that fair play and <br />these circumstances should allow Fina's request to change its <br />existing 30 foot sign to another 30 foot sign which, quite frankly, <br />has less signage area than the old four poster sign and is a more <br />attractive and modern appearing sign). <br />CONCO VARIANCE <br />By RESOLUTION NO. 87 -5 -223 (May 27, 1987) the City Council granted <br />Conco Shoes a variance to construct a 40 foot high pylon roof sign. <br />(copy attached. as Exhibit G). According to the City's Minutes, this <br />variance was granted in part based upon the City Planner's Report <br />of May 11, 1987 (File No. 758.09 - 81.28) which recommended the <br />granting of the variance based upon the topographic features of the <br />Conco site. From reading the City Planner's Report, it is clear <br />that the reason the topographic features were considered was that <br />it was difficult to see the Conco location due to its topography. <br />Based upon the City Council granting this variance, it is <br />respectfully submitted that the City has set a precedence allowing <br />variances when site location visibility is impaired. <br />In the Fina situation, it is submitted that the visibility of our <br />sign to the traffic heading south on Rice Street is greatly <br />diminished by the huge McDonald golden arches sign which is <br />directly to the North of our lot and which totally overwhelms our <br />signage. As the City has allowed a 40 foot nonconforming sign at <br />the Conco location to address its specific visibility problems, we <br />request that we be allowed to change our signage to the new two <br />poster corporate graphics which, we believe, will be more visible <br />at the intersection and which will allow our customers more advance <br />warning to safely enter our premise to purchase gasoline. <br />IV. <br />FINA HAS MET TO THE CRITERIA FOR A VARIANCE <br />In addition to the precedence set by the Conco and Union 76 <br />situations, it is further respectfully submitted that Fina has <br />Page 44 <br />
