MINUTES <br />City Council <br />•:Feb .' =:25 :1987,. <br />Ainion <br />Sign <br />'Height z -,; <br />Variance, <br />Agenda <br />Item No. 5 <br />Mayor Fahey opened the Public Hearing on the request of Roger <br />Phillips for a sign height variance at the Union 76 station located <br />on Little Canada Road. <br />Bob Sherlock, Suburban Lighting, appeared before the Council <br />representing Mr. Phillips and reported that Mr. Phillips is the <br />franchisee of the station. Mobile and Union 76 have traded <br />properties and the station will become a Union 76 station. Therefore, <br />Mr. Phillips is requesting a sign height variance so that he can <br />change the signage to Union 76. <br />Mrs. Scalze pointed out that Mr. Phillips has been the franchisee of <br />this station for the past 17 years, and all that is happening is that <br />the station is changing names. <br />Fahey pointed out that the Planning Commission has recommended <br />approval of the variance request as there is no change in the <br />franchisee of the business. <br />Fahey felt that as there was no change in the franchisee of the <br />property, a iance_was_not_nec_e.ssary_ to_change._the._existing signs <br />to Union 76 signs. However, should the franchisee of the oroperty <br />change, then the City's sign ordinance would become applicable, and <br />sign`-suu'rc1Tave to n-Yroligaifito conformance. <br />There was no one present from the general public wishing to comment. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 87 -2 -74 - CLOSING THE PUBLIC <br />HEARING ON THE VARIANCE REQUEST FOR SIGN HEIGHT <br />MADE BY ROGER PHILLIPS <br />The foregoing resolution was duly seconded by Mr. Blesener. <br />Ayes (5) Scalze, Blesener, Collova, Fahey, LaValle. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 17, Page 78. <br />The City Clerk pointed out that there are five legal descriptions <br />for this property. The Clerk suggested that the City require a <br />registered land survey of the property to simplify the legal <br />description. <br />Council pointed out that since a variance is not necessary, there <br />is no request to tie this condition to. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />Page 58 <br />E 6 ± F <br />.1 <br />
